  • LAST SITTING OF THE ARMS PROCUREMENT COMMISSION
    The public hearings of the Arms Procurement Commission will have its very last sitting on 29 June 2015. The Chairperson of the commission, Judge Seriti will make concluding remarks after the oral evidence of both BAE and SAAB are read on the record and the oral submission of Adv Fana Hlongwane.
    The media is invited to this important conclusion of a process that have taken four years.

  • PRESS RELEASE

    The public hearings of the Arms Procurement Commission adjourned after hearing the evidence of ThyssenKrupp Marine Systems. the company was represented by Klaus Wiercimok,a senior in-house attorney employed by the company.

    The next sitting is on Friday,20 March 2015.The companies that will testify are SAAB and Agusta. They supplied gripens, advanced light fighter aircrafts, and light utility helicopters respectively.

    The hearings will commence at 09:00.

    The testimony-in-chief of Dr.Richard Young ended and his cross examination is deferred to the week starting the 23rd March 2015.The public hearings will continue on the 16 March 2015(Monday) with testimony by a representative of ThyssenKrupp Marine Systems.

    Inputs by way of written or oral submissions by the legal representatives of interested parties are welcome and all legal representatives must submit their written submissions to the Commission at least a week before presentation of oral submissions.

  • PRESS RELEASE

    The Commission wish to put the following on record to clarify misconceptions.

    Adv. Fana Hlongwane did not appear at the Commission today,24 November 2014,and could therefore not have met the Commissioners. His lawyers did attend the hearings to represent him and they met with the evidence leaders and discussed his failure to attend. Both parties then briefed the Commission on the developments and it was given an assurance that he will co-operate and will testify on the agreed date of 11-12 December 2014.His evidence was accordingly deferred to the latter dates. Whether photos of him can be taken is a matter that can only be dealt with once he is before the Commission.

  • ADJOURNMENT OF THE PUBLIC HEARINGS

    The testimony of  Adv Fana Hlongwane has been adjourned until the 11 and 12  December 2014. The date was agreed to after the consultation between the evidence leaders and the legal representatives of the witness.

  • ADJOURNMENT OF THE PUBLIC HEARINGS

    The public hearings of the Arms Procurement Commission has adjourned after the testimony of Mr Sharmin Shaik. The Commission will resume on the 24th November 2014.The main witness will be Adv Fana Hlongwane. Supplementary  evidence of Admiral Green and Mr Mzimela will be presented at 9:30 then followed by the testimony of Adv Hlongwane at 10:00.

    The public hearings of the Arms Procurement Commission will commence on 10 November 2014,and not on the 3rd as per the previous schedule. On the 10 November 2014 the witness to take the stand is Mr Shamin Chippy Shaik, followed by Adm. Alan Green and Mr Masizakhe Zimela on the 12 November 2014.

    The public hearings of the Arms Procurement Commission will resume at 09:00 on Tuesday,7 October 2014.The legal representatives of one of the companies, Ferrostaal have objected to the use of a confidential company document that  Mr Terry Crawford Brown seeks to rely on for evidence. The objection will be dealt with at 09:00 tomorrow morning where-after the ordinary hearings will resume.

    The public hearings of the Arms Procurement Commission will resume on 6 October 2014.The witness to take the stand is Mr. Terry Crawford-Brown. He is the one who took Government to the Constitutional Court that resulted in the institution on the Commission by the President.

  • CHANGES TO THE PROGRAMME FOR THE SECOND PHASE OF THE PUBLIC HEARINGS

    The Commission wishes to draw attention to the changes made to its programme for the second phase of the public hearings which were to start on the 21st July 2014 and to run until the 13th August 2014.Of the witnesses who were scheduled to testify from 21st July to the 7th August 2014,only Ms Patricia de Lille, Mr David Maynier and Ms Raenette Taljaard have testified. The rest of the witnesses were not ready to testify on the dates set aside for them due to a variety of reasons, including that they needed more time to prepare. This has resulted in the whole programme being altered.

    Our evidence leaders are presently in discussions with legal representatives of the witnesses concerned to arrange new dates and as soon as these have been fixed, a revised programme will be issued. The only witness whose date has so far been fixed is Dr. Gavin Woods and the Commission will sit on Monday,25th August 2014 to hear his evidence. Hopefully by then the revised programme will be ready.

  • RESIGNATION OF EVIDENCE LEADERS

    The Arms Procurement Commission confirms that it received and accepted in principle the resignations of evidence leaders, advocates Barry Skinner, SC and Carol Sibiya. The reasons behind their resignations cannot be disclosed as they are the subjects of on-going engagement with the Commission. The Commissions operations will not be interrupted as they were working within a team that is fully informed and will proceed with  the responsibilities. The public hearings will commence on the 5th August 2014 with the testimony of Mr David Maynier, member of parliament.

  • ADJOURNMENT OF THE PUBLIC HEARINGS

    The public hearings of the Arms Procurement Commission were adjourned after one of the witnesses, Dr. Richard Young, failed to appear ,sending two  letters instead. The two letters and the medial certificate were read onto the record. The Chairperson of the Commission, Judge Seriti, reserved a ruling on the matter. The next witness to appear is Ms Patricia de Lille on Thursday,24 July 2014.

  • TESTIMONY OF FORMER PRESIDENT OF THE REPUBLIC OF SOUTH AFRICA, MR. THABO MBEKI

    The former President of the Republic of South Africa, Mr. Thabo Mbeki, will appear before the Arms Procurement Commission on Thursday,17 July 2014.
    His appearance will complete the first phase of the public hearings. The hearings will commence at 10h00, at the Council chamber, Sammy Marks Conference centre, Pretoria, Tshwane.

    The testimony of Mr. Trevor Manuel has been adjourned till tomorrow,Thursday,12,to allow interested parties to prepare for cross-examination. Lawyers for Human Rights and Mr Terry Crawford Brown requested and were granted an adjournment that will allow them to prepare for cross-examination.   • CHANGE IN THE SEQUENCE OF WITNESSES

    Take notice that there has been a change in the sequence of witnesses to be called to testify before the Commission next week and the dates of their appearance. The change has been necessitated by the need to conclude  the cross-examination of General P Steyn before Messrs R Kasrils and M Lekota are called, in order to minimise the risk of them having to be recalled to appear again. The Commission wishes to tender its apologies for any inconvenience caused to all the interested parties by this change.     The public hearings of the Arms Procurement Commission will resume on Thursday,3 April 2014.Mr Jacobus Gerhardus Grobler, employed by Amscor as Chief Financial Officer, gave testimony to the Commission on 1 April 2014,afterwhich the hearings were adjourned to Thursday to allow the evidence leaders time to do further consultation with the next witness.
  • ADJOURNMENT OF THE PUBLIC HEARINGS
    The public hearings of the Arms Procurement Commission are adjourned until Monday, the 1st April, 2014.The next witness to appear will be from Amscor. The Commission had  lengthy deliberation after Dr Richard Young brought three applications seeking discovery and production of various documents from the Commission, Armscor and the Department of Defence and Military Veterans. After deliberations by parties, the Commission refused all the three applications.

    The public hearings of the Arms Procurement Commission have been postponed to give evidence leaders more time to consult with witnesses who, some of them, are no longer residents of South Africa. Some are no longer at the employ of the companies they have to testify about. The hearings will commence on 24 March 2014.

    The public hearings of the Arms Procurement  Commission  are postponed and will resume on the 3th march 2014.The Chairperson granted the postponement after a submission from the legal representatives of the Department of Defence and Military Veterans. They requested that the Commission adjourns to allow them to prepare an order compelling one of the witnesses, Dr Richard Young, to discover with them. The Chairperson ruled that an order be prepared and send to Dr. Young to discover by Monday,3 March 2014. The Commission will proceed with its schedule on the 3rd March 2014.

    The public hearings of the Arms Procurement Commission has adjourned until the 17th February 2014 as the witness who has to testify has prior engagement outside the country and will only be available on the 17th February 2014.The Evidence leaders will then utilise the period for further consultation on the matter of declassification of documents.

    Phase 1 will be carried over to the new year and in turn this has necessitated that the schedule of witnesses and timetable be revised. The hearings will resume on the 20th January 2014 and will run until the 16th May 2014.

  • ADJOURNMENT OF THE PUBLIC HEARINGS
    The hearings of the Arms Procurement Commission have been adjourned for the week and will resume on the 30th September 2013.The venue will be utilised by the City of Tshwane for its council activities. The Commission will use the week to conduct further investigations and consultations.

  • PUBLIC HEARINGS: GENERAL SHOKWE
    The next witness to appear before the Commission is Chief of the South African National Defence Force, General Shokwe. He is going to take the stand on Friday, 20 September 2013. His testimony will focus on the role of the Defence Force and its obligations.

  • Witness for 19 September 2013: On 19 September 2013,General W.H. Hechter, former Chief of the South African Air Force, will give evidence to the Arms Procurement Commission. His expected to focus on deliberations relating to the two and three tier training systems of the SAAF and the ultimate decision to retain the three tier system.
  • POSTPONEMENT OF THE HEARINGS: Please take note that the public hearings of the Arms Procurement Commission that were due to continue on Monday,16 September 2013, have been postponed until Wednesday,18 September 2013.The Chairperson of the Commission, Judge Seriti, has fallen ill over the weekend and has been booked off to recuperate until Wednesday. The hearings will resume on Wednesday,18 September 2013.
